Para cualquier conocedor de la cultura sneaker es fácil encontrar imitaciones “piratas”, clones, copias, réplicas o como quiera llamarlas, en sitios de eccommerce, pero hallar un modelo de calzado diseñado por Kanye West en Walmart, es todo un hito.
Recientemente ha sido revelada a través de internet la existencia de unos Yeezy Foam Runner en el escaparate digital de Walmart, a razón de 24 dólares el par y por lo cual los abogados del artista ya han presentado su demanda al mayor empleador de los Estados Unidos.
Walmart bajo demanda por Kanye West
De acuerdo a los abogados del artista, la demanda alega que la marca Yeezy había enviado a Walmart “advertencias múltiples” para detener las ventas del calzado replicado de forma “prácticamente indistinguible”.
En particular, algunos medios también informaron que las imitaciones de Yeezy Foam Runners que todavía estaban disponibles en el sitio de Walmart después de que se presentó la demanda el 24 de junio.
En un comunicado emitido por Walmart, la compañía dijo que “tomará en serio acusaciones como esta y está revisando la afirmación. Responderemos en los tribunales según corresponda después de que se nos haya notificado la denuncia”.
La demanda afirma que la marca Yeezy ha perdido “cientos de millones” debido a los piratas, aunque es difícil estimar exactamente cuánto daño han causado estos listados de Walmart de terceros.
“Walmart está obviando flagrantemente la popularidad de la marca de West y Yeezy al ofrecer a la venta una versión de imitación del Yeezy Foam Runner”, dice la demanda.
Vale decir que esta tampoco es la primera disputa entre West y Walmart, ya que en abril, la última presentó una queja después de que Yeezy buscara registrar un logotipo que se parecía al que el gigante minorista ha estado usando desde 2007.
A lo que los abogados de West califican como “prácticamente indistinguible” también alcanza a otras representaciones de un modelo de sandalias Yeezy aún más cotizado que Forbes pudo confirmar.
Estamos hablando de las Yeezy Slides, que han sido versionadas de las misma manera que las Foam Runners, pero tal vez no han sido tan populares en cuanto a ventas, probablemente por su precio: unos 17,000 mexicanos en Farfetch, para la versión más cotizada, las “Enflame Orange”.
En este caso, las réplicas que se venden en Amazon por otros 30 dólares, o no han sido descubiertas aún por los abogados de Kanye West, o bien responde a un diseño que ha sido inspirado en uno anterior.
Forbes comprobó que las slides están a la venta en Amazon.
En este sentido, a diferencia del otro modelo, no hay constancias de reclamo por parte de West, y es un caso de copyright como en los diseños de innumerables tipos de bolsas, incluso algunas similares a las Birkin de Hermès.
En este tipo de modelo, son diseños heredados de antiguos equipajes y no se conoce su origen real, o realmente alguien pudiese haber patentado un diseño clásico como propio: mientras tanto, se siguen fabricando y vendiendo con éxito.
Si bien no se ha dado a conocer quién pudo realizar el diseño de las Yeezy Foam Runner más allá de la propia idea del propio Ye, se sabe que el artista ha contratado a celebridades del mundo del diseño para dar vida a algunos de sus más icónicos calzados.
Para las Yeezy VX, que hoy abundan en todos los tianguis de la ciudad en sus versiones clonadas, fueron diseñados por Christian Tresser, quien dio vida a las Nike Air Max 97, y Steven Smith, responsable de algunas de las Reebok Pump y las New Balance 1500.
Se desconoce quién fue la firma tras el icónico diseño de las Foam Runner, que más que un boceto normal, parecen haber surgido de un render futurista de alguna inteligencia artificial.
